ABOUT TDS Return Filing and Advisory Services

TDS is one of the modes of collection of taxes, by which a certain percentage of amounts are deducted by a person at the time of making/crediting certain specific nature of payment (whichever is earlier) to the other person and deducted amount is deposited in the Government account. It ensures regular inflow of cash resources to the Government. It acts as a powerful instrument to prevent tax evasion as well as expands the tax net. Person deducting tax is called deductor while the person from whom the tax is deducted is called the deductee.

The consequence of failure to deduct TDS may attract a penalty of amount equal to the deducted amount along with an interest @1% of the tax deductible.

The Due Date for depositing of TDS are as follows:

7th of the succeeding month

In cases of default to deposit the TDS amount with the government department penalty is attracted @ 1.5% of tax not deposited and imprisonment for a term which shall not be less than three months but which may extend to seven years and with fine under Section 276(B).

All deductors are compulsorily required to file their TDS return quarterly on electronic media as per prescribed data structure through applicable Forms accompanied along with Form 27A (declaration form).

For payments made to non-resident, not being a company, or foreign company or resident but not ordinarily resident.

If a deductor fails to submit return in time then a fine of Rs. 200/- every day during which the failure continues will be levied till the default continues, not exceeding the TDS amount.
